Data privacy statement

1. General

I, Marie-Josée Tintinger, holiday home rental specialist and owner of the website “Andalucia Natural”, takes the protection of your personal data seriously and adhere strictly to the data privacy regulations laid down in Germany’s Federal Data Protection Act (BDSG) and Telemedia Act (TMG) as well as the European General Data Protection Regulation (EU-DSGVO).

This privacy policy covers the usage of andalucianatural.de and andalucianatural.com services via PC’s, smartphones, tablets and all other internet-enabled mobile devices.

I would like to point out that data transmission over the internet (e.g. when communicating via email) can expose security vulnerabilities. Complete protection of data from access by third parties is not possible.

My digital offerings may contain links to other websites belonging to third party service providers, to which this data privacy policy does not apply.

2 Personal data

Personal data is information which discloses, or may disclose, the user’s identity. I adhere to the principle of only collecting the most necessary data. The collection of personal data will be refrained from as far as possible.

2.1 My handling of personal data

Personal data is used exclusively for the establishment of contracts, the structuring of their content, and the implementation or processing of the contractual relationship (Art. 6, para. 1, sub-para. b of the DSGVO). In addition, personal data will only be processed if I have received your consent for this purpose (Art. 6, para. 1, sub-para. a of the DSGVO). It will only be passed on to third parties or otherwise shared if this is necessary for the purposes of contract processing or billing, or if you have previously consented, or a legal basis for disclosure exists.

The necessary payment information for payment processing will be passed on to the financial institution through which payment is to be made and, if necessary, with the chosen payment service provider that has been engaged. The processing of your personal data takes place exclusively within the EU.

With business partnerships, a disclosure of your personal data to partners only takes place to the extent necessary for the partner concerned, for the purposes of contract formation and execution as well as further processing according to tax law. Both my business partner and I will be obligated as part of the partnership to heed the provisions of the data protection regulations. This obligation continues even after the termination of the contract in question.

2.2 Period of data retention

After the purpose for which your personal data was collected has been fulfilled, I will save your data only as long as required under statutory (and particularly tax law) regulations.

2.3 Plug-in provider

I work with the JFeWO plug-in from “B01 – office for modern media”. The personal data remains on the Andalucia Natural server and will not be passed on to third parties.

2.4 Google Translator

This site uses the Translator provided by Google to translate website content into other languages, a third party over which I have no influence whatsoever. The computer-generated translations are sometimes only approximations of the original contents of this website and the browser that you use has to establish a connection with Google’s servers. By this means, Google learns that my website was accessed via your IP address. Google Translator uses so-called “cookies” that are saved on your computer and which make an analysis of your use of my website possible. The information generated by this cookie regarding your use of my website will usually be transferred and stored on a Google server in the US.

The use of Google Translator is in the interests of a multilingual presentation of my online offerings. This represents a legitimate interest within the meaning of Art. 6, para. 1, sub-para. f of the DSGVO. If your browser does not support Google Translator, only the German language version of the website content is used by your computer. 2.5 Google Analytics (with anonymisation function)

This website uses Google Analytics, a web analytics service provided by Google, Inc. (“Google”). Google Analytics uses so-called “cookies” that are saved on your computer and which make an analysis of your use of my website possible. The information generated by this cookie on your use of my website will usually be transferred and stored on a Google server in the US.

Please note that Google Analytics has been extended on this website using the “anonymizeip” code to enable the anonymous collection of IP addresses (so-called IP masking). Your IP address will be shortened by Google within member states of the European Union or in other signatories to the agreement across the European Economic Area. Only in exceptional cases will the full IP address be transferred to a Google server in the US and shortened there. Google will use this information on behalf of the website owner to evaluate your usage of my website, to compile reports about your activities on the site, and to provide additional services relating to website and internet usage. The IP address transmitted from your browser as part of Google Analytics will not be amalgamated with any other data held by Google.

You can prevent cookies from being stored by configuring your browser software accordingly. Please note, however, that you may not be able to fully access all the functions of this website if you choose to do so. 2.6 Your usage data

General technical information is collected when you visit this website:

  • host name of the accessing computer (IP address)
  • date and time of server request
  • content of the request (specific page)
  • URL of the referrer (the page previously visited)
  • access status / HTTP status code.
  • volume of data transferred at a time
  • website from which the request comes
  • browser type/version
  • operating system and its user interface
  • language and version of the browser software

as well as other similar usage data and information are registered in a server log file for technical reasons and may be used for the purposes of threat prevention in the case of attacks, to ensure secure and stable website operation, and be used and stored for the statistical evaluation of this website. A linkage between this usage data and your other personal details does not take place.

The legal basis for this storage is Art. 6, para. 1, sub-paragraph f of the DSGVO. My legitimate interest is in the improvement, stability, functionality and security of my internet presence.

2.7 Google Maps

On this website I use the services of Google Maps. As a result, I am able to show you interactive maps on the website and allow you to use the map function easily.

As a result of your website visit, Google receives, among other things, the information that you have opened the corresponding subpage of our website. In addition, the data referred to under Point 2.6 of this policy will be submitted to Google, that is, regardless of whether you are logged in to a Google user account. If you are logged in to a Google user account, your data will be directly allocated to this account. Google stores your data as usage profiles and uses it for purposes of advertising, market research and/or the demand-oriented design of their own website.

You have the right to object to the creation of these user profiles. To exercise your right of objection, you have to contact Google directly. 2.8 Cookies

For the operation of my website I can set cookies or server-based sessions, in which data may be saved. Cookies are files that are stored on your hard drive from a website to automatically recognise your computer the next time you visit the website and so be able to customise the use of the website for you. Some of the cookies used are deleted again after the end of the browser session. These are so-called session cookies. Other cookies remain on your device and enable browser recognition during a later visit to my website (permanent cookies). Most web browsers automatically accept cookies. You can configure your browser in such a way that you are informed about the placement of cookies and can individually decide whether to accept them, or only accept them in certain instances, or whether to exclude them generally. Please note that if cookies have been disabled, you may continue to visit my website, however the functionality of some features might be affected.

3. Data security

All of the data you share with my website – such as enquiries – cannot be read by third parties, thanks to SSL encryption (Secure Socket Layer encryption system).

You can recognise links encrypted in this way by the prefix “https://” in the page link in your browser’s address bar. Unencrypted web pages are identified by “http://”. With correct SSL encryption, most browsers also display a green, locked padlock icon in the address bar.

All of the data on my website and other systems are safeguarded by technical and organisational means against the loss, destruction, access, alteration or dissemination of your data by unauthorised persons.

I make sure that no personal data is acquired from sessions or via cookies and that cookies are only utilised if this is necessary for the website. Hence my assessment that there are no overriding interests on your part which stand in the way (Art. 6, para. 1, sub-para. f of the DSGVO). 

4. Your rights

4.1 Information

You can request information from me about whether I process personal data of yours and, if this is the case, you have a right to information about this personal data and to further information as specified in Art. 15 of the DSGVO.

4.2 Right of rectification

You have the right to have incorrect personal data pertaining to you rectified, and you may request under Art. 16 of the DSGVO the completion of incomplete personal data.

4.3 Right of deletion

You have the right to request of me that personal data pertaining to you be deleted immediately. I am obligated to delete them at once, especially if one of the following reasons applies:

the personal data is, for the purposes for which it was collected or has in other ways been processed, no longer necessary.

you revoke your consent on which the processing of your data was based, and there is no other legal basis for the processing.

your data has been processed unlawfully.

The right to deletion no longer exists if your personal data is required for the raising, exercise or defence of my legal claims.

4.4 Right to limitation of processing

You have the right to request of me a limitation to the processing of your personal data if you dispute the accuracy of the data and I thus have to check it for accuracy,

the processing is unlawful and you decline deletion and instead request a limitation to the use of the personal data,

I no longer require the data, however you need it for the raising, exercise or defence of legal claims,

you have lodged an objection to the processing of your data and it is not yet clear whether my legitimate reasons will prevail over yours.

4.5 Right to data portability

You have the right to receive the personal data pertaining to you which you have provided to me in a structured, common and machine-readable format. You also have the right to share this data with another responsible party without obstruction from me, as long as the processing is based on a given consent or a contract and the processing in my case is carried out by means of automated processes.

4.6 Right of revocation

If the processing of your personal data is based on consent, you have the right to revoke this consent at any time.

4.7 General remarks, and the right of appeal

Your exercise of the above rights is free of charge to you as a matter of principle. You have the right to address complaints directly to the relevant data protection authority. The relevant authority in my case is:

5. Note:

If you discover content that is, in your opinion, illegal, especially with regard to copyright regulations, I would urge you to contact me directly in person, without engaging the fee-paying services of a legal representative. This is not necessary because you can be assured that, in the case of a legitimate claim, I will upon first demand and without delay seek a remedy and remove the questionable content. Thus, looked at objectively, the engagement of a legal representative is no longer required. I will protest against any costs that may arise in the course of this.
